1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Mesh ("Mesh," "we," "us," or "our") governing your access to and use of the Mesh platform, including our website, mobile application, APIs, and all related services (collectively, the "Service").

By creating an account, logging in, or otherwise using the Service, you confirm that you are at least 13 years old (or 16 years old in the European Union), that you have read and understood these Terms, and that you agree to be bound by them. If you are using Mesh on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

If you do not agree to these Terms, you must not access or use Mesh.

2. Description of Service

Mesh is a creator platform that allows users to:

• Share posts, projects, and media with the Mesh community
• Collaborate with other creators on paid and unpaid projects
• Build and publish AI-assisted applications, games, websites, and tools
• Sell digital products, services, templates, courses, art, and physical goods
• Create and manage community spaces with channels and members
• Subscribe to creator tiers and support creators financially
• Access purchased content through the Mesh library

Mesh reserves the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice where possible.

3. User Accounts

3.1 Registration

To access most features of Mesh, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for choosing a secure password and maintaining its confidentiality.

3.2 Account Security

You are solely responsible for all activity that occurs under your account. Notify us immediately at jacksonsk2012@gmail.com if you suspect unauthorized access or a security breach. Mesh will not be liable for losses arising from unauthorized use of your account where you failed to take reasonable precautions.

3.3 One Account Per Person

Each individual may maintain only one personal Mesh account. Creating multiple accounts to circumvent bans, restrictions, or platform limits is strictly prohibited.

3.4 Age Requirement

Users must be at least 13 years of age. Users under 18 must have parental or guardian consent. Users under 18 may not use payment features on the platform.

4. Content & Intellectual Property

4.1 Your Content

You retain ownership of all content you create, post, or upload to Mesh ("Your Content"), including posts, projects, images, videos, code, and listings. By submitting content to Mesh, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, display, reproduce, and distribute Your Content solely for the purpose of operating and improving the Service.

4.2 AI-Generated Content

Mesh provides AI-powered tools to help you build projects. You are responsible for ensuring that AI-generated content you publish complies with these Terms. You represent that you have the rights to publish such content and that it does not infringe any third-party intellectual property rights.

4.3 Content Standards

All content on Mesh must be accurate, lawful, and non-infringing. You represent and warrant that Your Content does not violate any applicable law or regulation, infringe any third-party intellectual property rights, contain malware or malicious code, or violate any provision of these Terms.

4.4 Mesh's Intellectual Property

The Mesh name, logo, platform design, and proprietary technology are owned by Mesh and protected by intellectual property laws. Nothing in these Terms grants you a right to use Mesh trademarks, service marks, or branding.

4.5 DMCA

If you believe content on Mesh infringes your copyright, please submit a DMCA takedown notice to jacksonsk2012@gmail.com with the subject line "DMCA Notice." We will review and act on valid notices in accordance with applicable law.

5. Payments, Fees & Payouts

5.1 Platform Fee

Mesh charges a 15% platform fee on all transactions processed through the platform, including product sales, community memberships, creator tier subscriptions, tips, and collab payouts. This fee is deducted before funds are transferred to the creator.

5.2 Stripe Connect

Payouts to creators are processed through Stripe Connect. To receive payments, you must complete Stripe's identity verification and onboarding process. Mesh does not store banking information — all payment data is handled securely by Stripe. You agree to Stripe's Terms of Service and Stripe Connect Agreement.

5.3 Refunds

All purchases on Mesh are final. Creators are responsible for honoring any refund commitments they make to buyers. Mesh may, at its sole discretion, process refunds in cases of clear fraud or platform error.

5.4 Taxes

You are responsible for all taxes arising from transactions on Mesh. Mesh may collect and remit sales tax where legally required. Mesh will issue tax forms (e.g., 1099-K) to eligible creators in accordance with applicable law.

5.5 Minimum Pricing

All paid listings on Mesh must be priced at a minimum of $1.00 USD. Mesh reserves the right to remove listings that violate pricing policies.

6. Prohibited Conduct

You agree not to, and will not permit others to:

• Post content that is illegal, harmful, abusive, harassing, defamatory, or discriminatory
• Post sexually explicit content involving minors under any circumstances
• Impersonate any person, entity, or Mesh employee
• Distribute malware, phishing links, or other malicious code
• Use automated bots, scrapers, or scripts to access Mesh without prior written consent
• Attempt to gain unauthorized access to any account, server, or system associated with Mesh
• Engage in spam, unsolicited messages, or platform manipulation (fake likes, fake followers, etc.)
• Sell counterfeit goods, stolen content, or infringe third-party intellectual property rights
• Use Mesh to launder money or conduct fraudulent transactions
• Circumvent or attempt to circumvent Mesh's payment systems or platform fees
• Create multiple accounts to evade bans or platform restrictions
• Encourage or facilitate any of the above activities

Violations may result in content removal, account suspension, or permanent termination, and may be reported to law enforcement where required.

6.1 User-Generated Content & Zero-Tolerance Policy

Mesh enforces a zero-tolerance policy for objectionable user-generated content and abusive behavior. This includes, without limitation: hate speech and slurs, harassment or bullying, sexual or pornographic content, any content that sexualizes or exploits minors, threats or incitement of violence, self-harm content, and spam or scams.

To keep the community safe, Mesh provides, and you agree to use responsibly, the following safeguards:

• Automated filtering. Content is screened when it is created; material that clearly violates this policy is blocked from being posted.
• Reporting. Every post, comment, profile, and community message can be flagged using the report control. Reports go directly to our moderation queue.
• Blocking. You can block any user at any time; blocked users' content is hidden from your feed instantly, they cannot interact with you, and the block is logged for our moderation team so we can act on repeated abuse.

We review every report and act within 24 hours. Objectionable content is removed and the users who posted it are warned, suspended, or permanently banned depending on severity. Content that sexually exploits minors or threatens others is removed immediately and reported to law enforcement. By posting content on Mesh you agree there is no tolerance for objectionable material, and that Mesh may remove content and terminate accounts at its sole discretion to enforce this policy.

7. Privacy

Your privacy matters to us. Our Privacy Policy describes how we collect, use, and share information about you when you use Mesh. By using Mesh, you agree that we may process your information as described in our Privacy Policy, which is incorporated into these Terms by reference.

We collect information you provide (name, email, payment info), information about your use of the platform (posts, likes, purchases), and device/technical information. We use this data to operate the Service, personalize your experience, process payments, and communicate with you.

We do not sell your personal information to third parties. We share it only with service providers necessary to operate Mesh (such as Stripe for payments) and as required by law.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. MESH DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE MAKE NO WARRANTIES ABOUT THE ACCURACY, RELIABILITY, OR QUALITY OF ANY CONTENT ON THE PLATFORM.

Mesh is a platform — we do not verify the accuracy of creator listings, endorse any product or service sold on Mesh, or guarantee the quality of any transaction between users.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MESH AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL MESH'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID MESH IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $100 USD.

10. Termination

You may delete your account at any time through your account settings. Upon deletion, your public content may be removed from the platform, though some information may be retained as required by law or for legitimate business purposes (such as transaction records).

Mesh may suspend or terminate your account at any time, with or without notice, for violation of these Terms or any applicable law. Upon termination, your right to use the Service immediately ceases. Pending payouts may be withheld for accounts terminated due to policy violations.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in Delaware, except that either party may seek injunctive relief in any court of competent jurisdiction.

If you are a resident of the European Union, you may also have rights under applicable EU consumer protection laws that cannot be waived by these Terms.

12. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will notify you via email or an in-app notice at least 14 days before the changes take effect. Your continued use of Mesh after the effective date constitutes acceptance of the updated Terms.

If you object to any changes, your sole remedy is to stop using Mesh and delete your account before the effective date.
